  • YAYOI KUSAMA Inc. (the “Company”, “we” or “us”) hereby establishes this privacy policy (the “Policy”) concerning the protection of personal information of individuals who apply to use the Yayoi Kusama Artwork Registration Program (the “Registration Program”). We handle personal information appropriately and in accordance with this Policy. Terms used in this Policy have the meanings defined under Japan’s Act on the Protection of Personal Information.

    1. Scope of This Policy

    This Policy applies to personal information that we obtain from an individual who applies for artwork registration or submits inquiries through Yayoi Kusama Artwork Registration System (the “Applicant”). Such personal information includes that of the owner of the artworks submitted by Applicant, and information regarding the artworks subject to the inquiry. If the Applicant is acting as an agent of the owner of artworks, the Applicant represents and warrants that the owner has agreed to this Policy.

    2. Information We Collect

    We collect the following personal information from the Applicant. By submitting personal information via our website or through direct communication with us, you are deemed to consent to the provision of your personal information with us.

    1. (i) Applicant and Owner Information
      Names, addresses, email addresses, and phone numbers of Applicant and the owner of the work
    2. (ii) Information of Works
      Provenance and related information
    3. (iii) Other Information
      Details included in your inquiries or other communications with the Company

    3. Purpose of Use

    We obtain and use personal information only for the following purposes (the “Purposes of Use”). Unless permitted under applicable laws and regulations, we will obtain your consent before using personal information beyond these Purposes of Use. Any updates to the Purposes of Use will be announced on our website.

    1. (i) To verify the identity of the Applicant and the owner of the works who use the Registration Program
    2. (ii) To confirm information necessary for the registration service or registration inquiries
    3. (iii) To collect, conserve, investigate and research information related to Yayoi Kusama artworks
    4. (iv) To invoice the Applicant for any fees or charges associated with the use of the Registration Program
    5. (v) To respond to registration inquiries from the Applicant
    6. (vi) To identify and prevent fraudulent or improper use of the Registration Program in violation of relevant terms and conditions thereof, and to address such fraudulent or improper use
    7. (vii) To provide personal information to third parties in accordance with Section 4 of this Policy

    4. Provision to Third Parties

    We do not provide personal information to third parties without the prior consent of the Applicant or the owner unless permitted or required by applicable laws and regulations. However, we may provide personal information to our group companies, including the Yayoi Kusama Foundation, for the purposes set forth in Items (i) to (iii) of Section 3, as well as for the following purposes: holding exhibitions of Yayoi Kusama artworks, conducting educational and outreach activities relating to art, and collecting, conserving, investigating and researching Yayoi Kusama artworks.

    5. Outsourcing

    We may outsource all or part of the handling of personal information to our group companies to the extent necessary to achieve the Purposes of Use.

    6. Security Measures

    We implement necessary and appropriate measures to prevent the leakage, loss, or damage of personal information and to ensure its secure management.

    7. Requests for Disclosure, Correction, or Suspension of Use

    (i) If an Applicant or the owner of artworks requests, in accordance with the applicable laws, notification of the purpose of use of retained personal information, disclosure of retained personal information, or disclosure of records of provision to third parties (“Notification/Disclosure Requests”), we will verify the identity of the individual making the request and respond without delay. If we do not have retained personal information that is subject to Notification/Disclosure Requests, we will notify you so. However, the Company may refuse disclosure in whole or in part if the Company is not obligated to address Notification/Disclosure Requests pursuant to applicable laws, or if addressing Disclosure Requests falls under the following:

    1. (a) harm the rights or interests in life, body, or property of the Applicant or third parties.
    2. (b) may significantly hinder our business operations.
    3. (c) would violate applicable laws and regulations.

    If we decide not to disclose, we will notify the Applicant without delay of its decision.

    (ii) If an Applicant or the owner of artworks requests, in accordance with the applicable laws, correction, addition, or deletion of retained personal information (“Correction Requests”), we will verify the identity of the individual making the request, conduct necessary investigations, correct, add or delete such retained personal information if it is found to be inaccurate, and respond without delay, unless the Company is not obligated to do so under the applicable laws. We will notify you without delay if we decide not to address Correction Requests.

    (iii) If an Applicant or the owner of artworks requests, in accordance with the applicable laws, suspension of use, deletion, or suspension of third-party provision of retained personal information (“Suspension Requests”), we will verify the identity of the individual making the request, suspend use of, delete or suspend provision of retained personal data and respond without delay, unless the Company is not obligated to do so under applicable laws. We will notify you without delay if we decide not to address Suspension Requests.

    (iv) If you desire to make requests under this Section, please contact us at the information set forth in Section 10 of this Policy. A fee of JPY 1,000 shall be charged for each request.

    8. Access Analytics Tools

    We use Google Analytics to analyze access to our website. Google Analytics uses cookies to collect data anonymously, and individuals cannot be identified.
    The Applicant may disable cookies through their browser settings to refuse data collection. For details, please refer to the Google Analytics Terms of Service and Google’s Policies and Terms. 。

    9. Changes to This Policy

    We may revise this Policy as necessary, except where otherwise required by law or by specific provisions of this Policy. Any updates will be announced or notified on our website.
