(the “Company”, “we” or “us”) manages and operates portrait rights, publicity rights, copyrights, trademark rights, and other intellectual property rights related to Yayoi Kusama and her artworks. If you are considering using Yayoi Kusama, her artworks or any other intellectual property rights managed and operated by us, please review the below and make sure to contact us in advance.

■Rights and Matters Requiring Your Inquiry Prior to Use

• Portraight rights and pubicity rights of Yayoi Kusama;
• Copyrights to photographs, images, videos, and other materials of Yayoi Kusama;
• Copyrights to Yayoi Kusama’s artworks;
• Copyrights to photographs, images, videos, and other materials of Yayoi Kusama’s artworks;
• Trademark rights related to Yayoi Kusama, her artworks, or the Company; and
• Copyrights to texts, illustrations, photographs, images, videos, and other materials on our websites.

Please note:
Some of the illustrations, photographs, images, videos, and other materials of Yayoi Kusama or her artworks may be subject to rights owned in part by third parties. If rights clearnce with third parties (including payments to third parties) is necessary, please contact and deal with such third parties at your responsibility and cost, in addition to contacting us.

■Matters Not Covered by Us

We do not respond to inquiries or consultations with respect to right infringements related to Yayoi Kusama or her artworks by third parties.

■Other Notes

• Yayoi Kusama does not operate any official social media accounts, including X, Instagram, Facebook, or YouTube. Further, the official websites operated by the Company and our group companies (including the Yayoi Kusama Foundation, hereinafter the same) are limited to the websites of yayoi-kusama.jp, YAYOI KUSAMA STORE, and the Yayoi Kusama Museum, and our official social media account is limited to the official Instagram account (@yayoikusamamuseum) operated by the Yayoi Kusama Museum.
• The Company and our group companies assume no responsibility for information other than information on our official websites or official social media accounts. Further, the Company and our group companies assume no responsibility for any damages arising out of or in relation to information on our official websites or official social media accounts, except for damages arising out of willful misconduct or gross negligence of the Company or our group companies.
• We assume no obligation to engage in or no responsiblility for any transactions or disputes related to Yayoi Kusama or her artworks (including forgeries and imitations) between any parties. Notwithstanding the foregoing, we may engage in such transactions or disputes at our discretion.
• We have the policy to strictly deal with the following, including by takedown notices and other injunctions, and claims for damages:
  • To use illustrations, photographs, images, videos, or other materials related to Yayoi Kusama or her artworks without our permission;
  • To plan, produce, manufacture, or sell forgeries or imitations of Yayoi Kusama’s artworks;
  • In addition to the above, any acts which or which may infringe upon the intellectual property rights of Yayoi Kusama, her artworks, or the Company; and
  • Any acts which or which may damage reputation or other social standing of Yayoi Kusama.

■Revisions

• We may amend or revise this Policy as necessary. Any amended or revised version of this Policy will take effect upon its posting on our website.
