Yayoi Kusama Inc. (the “Company”) deeply recognizes that the protection of personal information is an important issue that pertains to the safety of the life, body, and property of a person, gives first priority to the protection of rights and interests of individuals and the trust of its stakeholders, and has adopted the following basic policies to seek to properly manage personal information and individual numbers (collectively, “Personal Information, Etc.”), such as complying with the Act on the Protection of Personal Information (the “Personal Information Protection Act”), the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (the “Number Act”), and other laws and regulations, guidelines, and the like, and maintaining confidentiality and accuracy regarding Personal Information, Etc.
Article 1 Handling of Personal Information, Etc.
The Company will handle Personal Information, Etc. by lawful and fair means in accordance with, and only within the scope necessary for, the purpose of use of the Personal Information, Etc.Article 2 Purpose of Use and Manner of Use
1 The Company shall use Personal Information, Etc. received by the Company only within the scope of the purpose of recording information regarding owners and the like of Yayoi Kusama works in the Yayoi Kusama Works Registration System operated and managed by the Company, and other purposes of use that are expressly notified or announced by the Company to the principal, and if it is necessary to use personal information (excluding individual numbers) beyond the scope of the purposes of use, the Company shall obtain the prior consent of the principal regarding such use unless permitted by laws and regulations.
2 Unless the Company engages suppliers to perform services to achieve the purposes of use, or unless provided for in the provisions of laws and regulations or the like, or unless required for the protection of the life, body, or property of a person, the Company will not provide Personal Information, Etc. to a third party without obtaining the prior consent of the principal.Article 3 Management System
1 The Company will properly manage all Personal Information, Etc. so as to avoid loss, destruction, falsification, divulgence, or the like of such Personal Information, Etc. caused by unauthorized access, theft, removal, or the like, and will take necessary preventative and remedial measures such as the development of an organizational system.
2 If Personal Information, Etc. is used within the scope of the purpose of use when the Company outsources its business, the Company will enter into an agreement regarding the handling of personal information with such supplier, and will manage and supervise such supplier so that it appropriately conducts management.

1 The Company will seek to operate its business in accordance with the Personal Information Protection Act, the Number Act, and other laws and regulations, guidelines, and the like.
2 The Company will continuously review and improve its policies, systems, and the like to protect the Personal Information, Etc. possessed by the Company according to changes to the details of the Company’s business as well as changes to the laws and regulations, social environment, and IT environment surrounding the business, and other circumstances.
